1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:

2. Scope of Services
2.1 The Company provides rubbish removal and waste collection services, including household clearances, commercial clearances, garden waste removal, and general non-hazardous waste collection, subject to these terms and to applicable waste regulations.
2.2 The Company will collect Waste only from the location agreed at the time of booking. Any changes to the Site or access arrangements must be communicated in advance and may result in additional charges.
2.3 The Company reserves the right to refuse the collection of any items that fall outside the agreed scope, including hazardous, prohibited, or incorrectly described materials.
3. Booking Process
3.1 Bookings can be requested by telephone, email, or through any booking system operated by the Company. The Client must provide accurate information about the type, approximate volume, and location of the Waste, as well as any access restrictions.
3.2 Any quotation provided prior to the Site visit is an estimate only and is based on the information supplied by the Client. The final price will be confirmed once the Company has inspected the Waste and assessed access, loading conditions, and volume.
3.3 A booking is only confirmed when the Company has accepted the request and provided a confirmation via email, text, or verbal acceptance, and when any required deposit or pre-payment has been received.
3.4 The Client is responsible for ensuring that an authorised person is present at the Site at the agreed time of collection to provide access, confirm the Waste to be removed, and approve any changes to the quoted price if required.
4. Access and Client Responsibilities
4.1 The Client must ensure that the Company has safe, clear, and reasonable access to the Site and to the Waste at the agreed time. This includes arranging parking, entry to buildings, gates, or communal areas where needed.
4.2 Any parking fees, permits, or access charges required to carry out the Services shall be the responsibility of the Client and may be added to the final invoice if initially paid by the Company.
4.3 The Client must ensure that the Waste presented for removal matches the description provided at the time of booking. The Company may amend the price or decline to proceed if the Waste is significantly different in volume, weight, type, or access difficulty.
4.4 The Client agrees not to include in the Waste any dangerous, prohibited, or hazardous materials, including but not limited to asbestos, certain chemicals, clinical waste, gas cylinders, explosives, or any items that may pose a health and safety risk.
5. Quotations and Pricing
5.1 Quotations are based on estimated volume, weight, labour time, and disposal costs and are subject to revision once the Waste has been inspected on Site.
5.2 The final price will be confirmed before any loading begins. By allowing the Company to commence loading, the Client is deemed to have accepted the final price.
5.3 Prices are usually calculated based on load size, weight, type of Waste, access conditions, and any additional labour required, such as dismantling or moving items from upper floors.
5.4 Unless explicitly stated, prices are exclusive of any parking fees, congestion or clean air charges, or other third-party costs incurred in providing the Services. These may be added to the final invoice.
6. Payments
6.1 Payment is due on completion of the Services, unless otherwise agreed in writing in advance. The Company may require full or partial payment prior to the commencement of the Services.
6.2 Accepted payment methods will be communicated at the time of booking and may include cash, card, or bank transfer. The Company does not accept payment by cheque unless expressly agreed.
6.3 For business Clients with agreed account terms, invoices are payable within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.
6.4 The Company reserves the right to charge interest on overdue amounts at the statutory rate applicable to late commercial payments and to recover any reasonable costs of debt collection.
6.5 The Client shall not be entitled to withhold, deduct, or set off any sums from payments due to the Company unless required by law or agreed in writing.
7. Cancellations and Amendments
7.1 The Client may cancel or amend a booking by giving the Company reasonable notice by telephone or email.
7.2 If the Client cancels a booking less than 24 hours before the scheduled arrival time, the Company may charge a cancellation fee to cover lost time and costs.
7.3 If the Company arrives at the Site at the agreed time and is unable to gain access, or if the Client is not present and has not arranged access, this may be treated as a late cancellation and a call-out or cancellation fee may apply.
7.4 The Company reserves the right to cancel or reschedule a booking due to events beyond its reasonable control, including but not limited to severe weather, vehicle breakdown, accidents, or illness. In such circumstances, the Company will aim to provide as much notice as possible and will offer a new appointment time.
8. Service Delivery and Timeframes
8.1 Any times or dates given for arrival or completion are estimates only and are not guaranteed. While the Company will use reasonable efforts to attend within the agreed time window, delays can occur.
8.2 The Company shall not be liable for any losses, costs, or expenses incurred by the Client as a result of delays or rescheduling, provided the Company has acted with reasonable care and diligence.
8.3 The Client should not arrange other contractors, deliveries, or time-sensitive activities strictly dependent on the Companys arrival or completion time without allowing sufficient flexibility.
9. Waste Regulations and Environmental Compliance
9.1 The Company operates in accordance with relevant UK waste regulations and environmental legislation. All collected Waste will be transported and disposed of using licensed facilities or lawful methods.
9.2 By using the Services, the Client authorises the Company to remove and dispose of the Waste on their behalf. Ownership of the Waste transfers to the Company once it has been loaded onto the vehicle, except in cases of unauthorised or hazardous items.
9.3 The Client is responsible for ensuring that they have the legal right to dispose of the items presented as Waste and that no third party has a claim of ownership over them.
9.4 If the Client presents hazardous or prohibited materials without prior disclosure, the Company may refuse collection, request immediate removal from the vehicle, or apply additional charges to cover handling, specialist disposal, or any incurred penalties.
9.5 Upon request and where applicable, the Company may provide confirmation that Waste has been handled in compliance with relevant waste carrier and disposal regulations.
10. Health and Safety
10.1 The Company will carry out the Services with due regard to health and safety considerations for its staff, the Client, and the public.
10.2 The Client must inform the Company of any known hazards at the Site, such as structural issues, contaminated areas, dangerous materials, or restricted access points.
10.3 If the Company considers that carrying out the Services would pose a health or safety risk, it may suspend or cancel the Services, in whole or in part, and may propose alternative solutions or revised pricing.
11. Liability and Limitations
11.1 The Company will exercise reasonable care and skill in providing the Services. However, the Companys liability is limited as set out in this section.
11.2 The Company shall not be liable for any damage to property or belongings that arises from pre-existing defects, poor installation, or inherent weaknesses, including but not limited to damage when moving or removing items that are already damaged, corroded, waterlogged, insecurely fixed, or fragile.
11.3 The Client is responsible for protecting floors, walls, and surfaces if they are concerned about potential scuffs or marks during removal. The Company will take reasonable care but is not liable for minor cosmetic damage that may reasonably occur in the course of normal removal activities.
11.4 To the fullest extent permitted by law, the Company shall not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services.
11.5 Nothing in these Terms and Conditions excludes or limits the Companys liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be limited or excluded by law.
11.6 Subject to the above, the Companys total aggregate liability for any claim or series of related claims arising out of the Contract shall not exceed the total price paid or payable by the Client for the Services giving rise to the claim.
12. Client Indemnity
12.1 The Client agrees to indemnify the Company against all losses, costs, claims, damages, and expenses arising from:
a. Any breach by the Client of these Terms and Conditions.
b. The presentation of hazardous, prohibited, or illegally held items as Waste.
c. Any claim by a third party regarding ownership of items removed as Waste.
13. Complaints and Dispute Resolution
13.1 If the Client is dissatisfied with any aspect of the Services, they should contact the Company as soon as reasonably possible, providing full details of the issue.
13.2 The Company will investigate complaints in good faith and, where appropriate, may offer a remedy such as a partial refund, re-attendance, or alternative resolution.
13.3 If a dispute cannot be resolved amicably, either party may pursue their legal remedies in accordance with the governing law and jurisdiction set out below.
14. Data Protection and Privacy
14.1 The Company may collect and use personal data such as names, contact details, and Site addresses for the purpose of managing bookings, providing Services, processing payments, and handling queries.
14.2 The Company will handle personal data in accordance with applicable data protection laws and will take reasonable steps to safeguard such information.
14.3 The Client is responsible for ensuring that any personal data they provide is accurate and up to date.
15. Amendments to Terms
15.1 The Company may update or revise these Terms and Conditions from time to time. The version in force at the time of the booking will apply to that particular Contract.
15.2 Updated terms may be provided to the Client or made available upon request.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by the Company.
17. General Provisions
17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
17.2 No failure or delay by the Company to exercise any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
17.3 The Contract is between the Company and the Client. No other person shall have any rights to enforce any of its terms.
17.4 These Terms and Conditions, together with any written quotation or confirmation, constitute the entire agreement between the parties relating to the Services and supersede any prior discussions, correspondence, or understandings.
